These Terms of Use govern your access to and use of AIPhoto.net and all associated services. By using our service, you agree to these terms. Please read them carefully.

1. Service Overview

AIPhoto.net provides AI-powered image generation and enhancement services using third-party AI models. The service is provided on a best-effort basis and may be modified or discontinued at any time.

2. Eligibility

You must be at least 13 years old to use AIPhoto.net. Users under 18 must have parental or guardian consent. By using the service, you confirm you meet these requirements.

3. Permitted Use

You may use AIPhoto.net to:

• Generate AI images for personal, creative, educational, or commercial purposes.
• Download and use generated images subject to these Terms.
• Share generated images with attribution to AIPhoto.net (appreciated but not required).

4. Prohibited Content

You must not use AIPhoto.net to generate:

• Any content that sexualizes minors (CSAM). This is strictly prohibited and immediately reported to authorities.
• Defamatory, harassing, or non-consensual depictions of real individuals.
• Content designed to incite violence or discrimination based on protected characteristics.
• Deliberately deceptive political disinformation or deepfakes intended to cause harm.
• Content that violates third-party intellectual property rights.

Violation of these rules will result in permanent IP-level blocking and, where required by law, reporting to law enforcement authorities.

5. Intellectual Property

5.1 Your Generated Content

You retain full rights to images you generate using AIPhoto.net, including the right to use them commercially. The underlying model providers' terms also apply.

5.2 AIPhoto.net Platform

The AIPhoto.net website, code, design, brand identity, and original content are our intellectual property. You may not copy, reproduce, or redistribute any part of the platform without written permission.

6. Rate Limits and Fair Use

The free tier provides 5 image generations per IP address per day. Circumvention of rate limits via VPNs, proxy services, or automated scripts in bad faith violates these Terms and may result in a permanent ban.

7. Service Availability

We do not guarantee uninterrupted availability. The service depends on third-party AI APIs that may experience downtime. We are not liable for any loss resulting from service unavailability.

8. Disclaimer of Warranties

AIPhoto.net is provided "AS IS" without any warranty of any kind, express or implied. We do not warrant that generated images will be accurate, appropriate, or meet your expectations. Use generated content responsibly and verify before publishing.

9. Limitation of Liability

To the maximum extent permitted by law, AIPhoto.net's total liability to you for any claim arising from these Terms or your use of the service shall not exceed €10 (ten euros). We are not liable for indirect, consequential, or incidental damages.

10. Third-Party Services

Image generation depends on third-party AI APIs (OpenRouter, OpenAI, Black Forest Labs, Stability AI). Their service terms and content policies also apply to your use. We are not responsible for third-party API changes, outages, or policy decisions.

11. Modifications

We may modify these Terms at any time. Updated terms take effect upon posting. Continued use after changes means you accept the new Terms.

12. Governing Law

These Terms are governed by applicable law. Disputes shall be resolved through good faith negotiation or, if necessary, binding arbitration.
